Terms of Service

These terms are an agreement between you and Rocket Full, Ltd. Co. ("we", "us") for the PUZZET website and Android app (together "the Service"). By using the Service you agree to them and to our Privacy Statement. If you do not agree, do not use the Service.

1. Who can use it

You must be at least 13 years old to create an account. If you are under the age of majority where you live, a parent or guardian must agree to these terms for you. Teachers who use the Service with students are responsible for that use. You can play puzzles without an account.

2. Your account

Give accurate information, keep your password secret and tell us if you think your account was accessed without permission. You are responsible for what happens under your account. One person may not run accounts to get around limits, rating or reward rules.

3. Your content

You keep ownership of puzzles, word lists and other content you create ("your content"). By submitting it you give us a worldwide, royalty-free, non-exclusive licence to host, store, reproduce, adapt (for example to lay out and print), display, distribute and promote it in connection with the Service, for as long as it is on the Service and for a reasonable time after for backups. If you make a puzzle public, you also allow other people to play it online and print it for personal and classroom use.

You promise that you have the right to share your content and that it does not break the law or anyone's rights. Do not post anything that is unlawful, hateful, harassing, sexual, violent, misleading, spam or malware, that infringes copyright or privacy, or that is not suitable for a service used in classrooms. We may review, edit, hide, unpublish or delete any content at any time, but we have no duty to monitor it. Puzzles and ratings from other people are theirs, not ours, and we do not vouch for them.

To report content you believe infringes your rights, email us with the link, what is infringed and your contact details, and we will review it.

4. Using the Service

Do not misuse the Service. In particular, do not scrape or copy it in bulk, interfere with or overload it, probe it for weaknesses, bypass limits, automate play or voting, farm coins, manipulate ratings or statistics, impersonate others, or use it to harm anyone. You may print puzzles for personal and classroom use, but may not sell them or the Service's content as your own.

5. Coins, scores, ratings and difficulty

Coins, stars, scores and similar items in the Service are for fun. They have no cash value, cannot be bought, sold or transferred, and are not your property. We may change how they are earned or spent, set daily limits, correct or remove coins, reset balances and change or remove features at any time. Difficulty labels, ratings and recommendations are automatic estimates and may be wrong.

6. Advertising and third parties

The Service may in future show advertising or sponsored content, and may link to or rely on third-party services. We are not responsible for third-party sites, services or ads, and your dealings with them are your own. See the Privacy Statement for how advertising may affect your data.

7. Our rights in the Service

The Service, including its software, design, logos, mascot and artwork, belongs to us or our licensors and is protected by law. We give you a limited, revocable, non-transferable permission to use the Service as intended. Apart from that and the licence you give in section 3, nothing here transfers any rights. If you send us ideas or feedback, we may use them without obligation to you.

8. Ending access, and changes

We may suspend or terminate any account, remove or hide any puzzle or other content, limit features, or end your access to all or part of the Service at any time, for any reason or no reason, with or without notice. We may also change, pause or discontinue the Service, or any part of it, at any time. You may stop using the Service and delete your account at any time from your profile page. When access ends, your right to use the Service ends; sections that by their nature should continue (including 3, 5, 7 and 9 to 12) will continue.

9. No guarantee of service or longevity

We make no promise that the Service, or any puzzle, account, coin balance, score, saved item or other data, will be available, uninterrupted, error free, secure or kept for any length of time. The Service may go down, change or end without notice. Keep your own copy of anything you cannot afford to lose, such as puzzles you made.

10. Disclaimer

The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. Puzzles are provided by users and may contain mistakes or content you find objectionable. Educational use is at the teacher's own judgment.

11. Limit of liability

To the fullest extent the law allows, we and our owners, officers, employees and providers are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, profits, goodwill or the loss of access to the Service, however caused, even if told of the possibility. Our total liability for any claim relating to the Service is limited to 100 US dollars. Some places do not allow these limits, so some of them may not apply to you.

12. Indemnity and disputes

You agree to defend and reimburse us for claims, losses and costs (including reasonable legal fees) arising from your content, your misuse of the Service or your breach of these terms. These terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law rules, and disputes will be brought in the state or federal courts located in Kentucky, except that either party may seek urgent relief to protect its rights anywhere. Any claim must be brought within one year after it arises, and only on an individual basis, not as a class or group action, to the extent the law allows.

13. Changes to these terms

We may update these terms at any time. The new version applies once it is posted with a new date. Continued use of the Service after that means you accept it. If a part of these terms is found unenforceable, the rest still applies, and our not enforcing a part is not a waiver of it. These terms and the Privacy Statement are the entire agreement between you and us about the Service.
